Assumption of Risk, Release of Liability, Waiver of Claims, and Indemnification Agreement

By completing this form and providing your electronic signature, you acknowledge that you have carefully read this Agreement, understand its contents, and voluntarily agree to all of its terms and conditions.

Assumption of Risk

I understand that participation in the La Vida Bocas Inflatable Water Park involves inherent and unavoidable risks that may result in serious injury, permanent disability, drowning, illness, property damage, or death.

These risks include, but are not limited to:

Slipping, falling, jumping, diving, or climbing.

Contact with other participants.

Strong currents, waves, tides, changing water conditions, or weather.

Floating structures shifting or moving.

Hidden underwater objects.

Marine life, including fish, jellyfish, stingrays, sea urchins, coral, and other aquatic animals.

Sun exposure, dehydration, heat illness, and exhaustion.

Equipment failure or misuse.

Delayed emergency response due to the property's island location.

No Lifeguard on Duty

I understand and acknowledge that:

NO LIFEGUARD IS ON DUTY.

I am solely responsible for my own safety and the safety of any minor children under my supervision.

I will only participate if I am able to swim adequately or if I am wearing an appropriate flotation device.

Children must be continuously supervised by a responsible adult.

Health Certification

I certify that:

I am physically able to participate.

I have no medical condition that would make participation unsafe.

I accept full responsibility for determining whether I am fit to participate.

If I have epilepsy, heart disease, respiratory illness, recent surgery, pregnancy, balance disorders, or any other medical condition that may increase my risk, I understand that I should not participate without approval from my physician.

Release of Libility

To the fullest extent permitted by applicable law, I voluntarily release and forever discharge:

C Spot Corporation d/b/a La Vida Bocas, including its owners, directors, officers, employees, contractors, guides, captains, volunteers, agents, affiliates, insurers, successors, and assigns,

from any and all claims, liabilities, demands, lawsuits, damages, costs, expenses, attorney fees, injuries, illnesses, property damage, wrongful death claims, or causes of action arising from or relating to my participation, whether caused by ordinary negligence or otherwise.

This release applies to all claims, whether known or unknown, anticipated or unanticipated.

Assumption for Responsibility for Minors

If I am signing on behalf of a participant under the age of 18, I certify that I am the child's parent or legal guardian.

I agree that:

I have explained the risks to the child.

I accept full responsibility for supervising the child.

I assume all risks on behalf of the child.

I release the Released Parties from liability to the fullest extent permitted by law.

Property Damage

I accept responsibility for any damage that I, or anyone under my supervision, causes to the inflatable water park, docks, boats, equipment, or other property due to reckless, intentional, or negligent conduct.

Emergency Medical Care

In the event of illness or injury, I authorize La Vida Bocas staff to obtain emergency medical assistance if deemed necessary.

I understand that:

Emergency transportation may require a boat.

Medical care may be delayed due to the property's remote island location.

I am solely responsible for all medical expenses.

Indemnification

I agree to defend, indemnify, and hold harmless C Spot Corporation d/b/a La Vida Bocas from any claims, damages, liabilities, judgments, costs, or attorney fees arising from:

My actions.

My negligence.

My violation of park rules.

Any claims brought by members of my group or minors under my supervision.

Personal Property

I understand that La Vida Bocas is not responsible for lost, stolen, or damaged personal belongings.

Photography & Media Release

I understand that photographs or videos may be taken in public areas of the property.

Unless I notify La Vida Bocas in writing before participation, I grant permission for photographs or videos that include me to be used for promotional, marketing, social media, or educational purposes without compensation.

Governing Law

This Agreement shall be governed by the laws of the Republic of Panama.

Any disputes arising from this Agreement shall be subject to the jurisdiction of the competent courts of Panama unless otherwise required by applicable law.

Severability

If any provision of this Agreement is found to be unenforceable, all remaining provisions shall remain in full force and effect.

Entire Agreement

This Agreement represents the complete understanding between the participant and C Spot Corporation La Vida Bocas regarding participation in the La Vida Bocas Water Park.
